Welcome to Chesed of Lakewood (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our services, including our website, SMS communications, and related offerings. By engaging with our services, you agree to these Terms. If you do not agree, please refrain from using our services.
 
1. Use of Services
  • Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement to use our services.
  • Chesed of Lakewood provides assistance to families in crisis in which every way is deemed necessary.
  • Prohibited Activities: You agree not to misuse our services, including but not limited to fraudulent activities, interference with our operations, or violation of applicable laws.
 
2. User Responsibilities
  • Accurate Information: You are responsible for providing accurate and up-to-date information to facilitate the delivery of our services.
  • Communication: You agree to respond promptly to our communications to ensure the smooth execution of services.
 
3. Payment Terms
  • There are no fees for joining Chesed of Lakewood’s SMS messaging.
 
4. SMS Communications and Opt-Out
By providing your mobile number, you consent to receive SMS messages from us regarding our services, notifications, and other relevant information.
  • Opt-Out: You can opt out at any time by replying “STOP” to a message sent to you. After sending “STOP,” we will confirm your unsubscription via SMS, and you will no longer receive messages from us.

Service-Related Messages: However, please note that we may still communicate with you for non-marketing purposes, including but not limited to sending service-related messages necessary for the administration and use of your account, responding to service requests, or fulfilling other contractual obligations related to the services you’ve requested.
  • Re-Enrollment: To rejoin, sign up again or reply “START” to our messages, and we will resume SMS communications.
 
5. Assistance and Support
If you experience issues with our messaging program:
  • Reply with the keyword “HELP” for additional assistance.

6. Carriers and Messaging
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages. While we strive to ensure timely delivery, delays may occur due to technical issues.
  • Message Rates: Message and data rates may apply for any SMS messages sent to or received from us. Contact your wireless provider for details about your text or data plan.
 
7. Privacy and Confidentiality
We are committed to protecting your personal information. Please refer to our Privacy Policy for information on how we collect, use, and safeguard your data. We do not sell your personal information with third parties for marketing purposes without your explicit consent.
 
8. Limitation of Liability
To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of our services even if we have been advised of the possibility of such damage.
 
9. Modifications to Terms
We may update these Terms from time to time. Updates will be posted on our website, and the “Effective Date” will be revised accordingly. Your continued use of our services constitutes acceptance of the updated Terms.
 
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of NJ,  without regard to its conflict of law principles. Any legal action or proceeding under or in connection with these Terms shall be brought exclusively in the courts located in Ocean County, NJ, and you consent to the personal jurisdiction and venue of such courts.
